Q I don’t see the specialty I’m looking for. What about experts or areas of expertise that are not on your list?
A We have spent years developing an extensive database and honing our network of connections to assist in finding expert witnesses If we don’t have the expert or specialty that you need, we will conduct an extensive search to find an expert for you for a flat fee of $350.
Q How much do your services cost?
A ECS works one of two ways…We have 150+ experts with whom we work on a regular basis. These experts pay ECS a commission in return for administrative support and marketing services. If you choose to use one of these ECS-related experts for your case, the engagement letter and the bills will come from ECS, but you will only be billed for the expert’s time. There is no additional charge from ECS.Alternatively, if none of the ECS-related experts is the right fit for your case, ECS will find an expert for you for a flat fee of $350.
Q Why should I use ECS?
A
  1. We provide a single point of contact for locating, scheduling, and communicating with experts.
  2. We simplify your job by picking up and copying your documents, organizing and delivering the copies to the expert, and returning the originals to you. This is done immediately after you retain one of our experts so that the expert has sufficient time to properly review and understand your documents.
  3. We put you in immediate contact with your retained expert so that you and the expert can work together to define the parameters of your relationship.
  4. We maintain current Rule 26(a)(2) disclosure information for all of our experts, and will promptly provide you with this information upon retention of an expert.
  5. When a written report is requested, we work with the expert to provide you with the report as quickly as possible.
  6. When a deposition is requested, we will gladly contact all parties regarding availability, arrange for a convenient facility and schedule a court reporter.

As a case approaches trial, we will work with you and your expert to coordinate scheduling.


FAQs about providing expert services

Q Who can be an expert?
A An expert is any person who, based upon their knowledge, skill, experience, training, or education, can provide an opinion about or interpretation of evidence or certain facts. Usually, an expert is hired, or retained, by an attorney to assist in understanding issues or facts in a case. Often, though not always, the expert is hired with the expectation that the expert will testify at trial to help explain the issues or facts to the judge or jury. Under both the Colorado and Federal Rules of Evidence, testimony of an expert may be allowed when “scientific, technical, or other specialized knowledge will assist the trier of fact to understand the evidence or to determine a fact in issue…” C.R.E. 702. In other instances, an expert will be retained solely as a consultant to help the attorney to prepare the case or to better understand the case. Experts may also be retained by the Court as well as by the neutral parties in alternative dispute resolution proceedings (mediation, arbitration, etc.) to assist them in understanding the issues or facts in the case.
Q I already work as an expert in many judicial matters, why should I sign up with ECS?
A There is no charge or obligation to you to sign up. Our agreement is non-exclusive and only applies in the event that you agree to take a case through ECS. Q I’m interested in rendering opinions, but I’m concerned about the effects of testifying on my regular schedule. How often should I expect to be testifying in court?
A According to the most recent statistics provided by the Colorado State Judicial Branch, less than 1% of all civil cases filed in the State of Colorado actually go to trial. More likely is the possibility that you will be asked to give testimony in a deposition. However, even depositions are a relatively rare occurrence in cases where experts are retained.

Q How much should I charge for my services?
A Appropriate and reasonable fees are dependent upon your particular field of expertise, your level of experience, your education, your particular training, as well as your geographic location. ECS is familiar with expert fees across the state and can provide you with reliable information upon which you can base your rate.
Q I’m a health care provider but I don’t have an office where I can offer examination services. How can I make arrangements to provide such services?
A ECS has an examination room, professionally equipped, that can be reserved for conducting examinations at our centrally located facilities near I-25 & Evans. We also have arrangements across Colorado should the need arise to conduct an examination in another location.
